If the dispute cannot be resolved through negotiation, it shall be referred to and finally resolved by arbitration administered under the Arbitration Act 2055 (1999) of Nepal. The seat of arbitration shall be Kathmandu, Nepal, and the language of arbitration shall be English.

Nothing in this clause shall prevent either party from seeking injunctive or other equitable relief from the courts of competent jurisdiction in Kathmandu, Nepal.
